Dr. Jekyll and Mr. Hyde (Updated)
/WIS Sports Anchor Joe Gorchow signed off from his live shot with a smiling face. But, the live shot did not go as planned and the folks back in the control room knew he was going to blow his top.
So, someone got out their phone and started rolling.
And they were right.
(Update) There was a video here of the incident that we have taken down the embed link to.
The video was not posted by FTVLive and was posted to YouTube by a an account using the name SanVic. Here is a screenshot of that YouTube account:
FTVLive does not know this person nor have we knowingly ever talked or exchanged messages with this person.
FTVLive embedded the video which is within the rights of the YouTube terms of service. This is the YouTube policy:
6.C. For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to YouTube, you hereby grant YouTube a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and YouTube’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service.
In other words, the only way that video made it onto FTVLive is it was embedded from the SanVic YouTube channel.
This is a practice done by millions if not billions of websites and one that was ruled on by the Supreme Court which said, the Court found no copy was made by the social media bookmarking site resulting in the termination of the infringement claim. Put more succinctly; you embedding a YouTube video on your site does not give rise to liability.
FTVLive was contacted by a lawyer for Gorchow that has claimed the video violates copyright.
Again, FTVLive has never had the video in our possession and we only embedded the video from the sharing website YouTube.
We have taken the embed link off this story. Gorchow’s lawyers says that the person that uploaded this video is not the copyright holder.
We do not know if this information is correct or not? But, we have decided to pull the embed down as a gesture of good faith.
