Sinclair Station Tries to Get Lawsuit Moved to Federal Court
Caruso has been in a wheelchair his entire life, stricken with spinal muscular atrophy. He has worked at the station for almost 30 years and his current salary is just $42,000. Caruso is liked by just about everyone on staff and he works hard.
But, he was faced with suing the station after the station switched his schedule then refused to accommodate his extreme handicap, according to his lawsuit.
Caruso claims that shift change has made his day-to-day routine much harder and caused his condition to worsen.
Sinclair is now trying to get the case moved from county court to federal court. It's the feeling that federal court is much more corporate friendly and Sinclair will have a better shot of winning the lawsuit.
In their federal filing, Sinclair attorneys admit they’re potentially facing serious damages, including punitive damages that could reach at least $100,000.
Sinclair is also claiming the station’s headquarters are really in Maryland, not West Palm Beach, the station’s physical address, so the case should be moved to federal court.
Whether Sinclair moves the case or not, PR wise this is not good for the station.
In a station press release about the November book (which the lost by a wide margin to WPTV), it quotes WPEC GM Mike Pumo says, “It’s exciting to be part of a company that is investing in local news." “We want to do it right."
They maybe investing in news, but not in their employees.
As for "doing it right."
